Regardless of the reasons, it seems like several big businesses are distancing themselves from WikiLeaks as fast as they can. This week, a third-party WikiLeaks app was removed from the Apple App Store for an alleged terms of service violation. Despite that, the app was bought over 4,000 and the developer will be donating $1 per download to WikiLeaks themselves.

Not sure how WikiLeaks themselves feels about it, but it seems a bit disingenuous that some random developer was making a WikiLeaks app on his own and taking some profit from it. He’s fully disclosed how much he’s made from it ($5,840) and how much he will donate to WikiLeaks ($4,443).

Some WikiLeaks supporters likely believe that Apple pulled the app due to CIA intervention or some other form of government pressure, but it seems the app was in violation of Apple’s App Store terms of service, section 21.1 which says:

Apps that include the ability to make donations to recognized charitable organizations must be free.

As I said in the open, I find it slightly distasteful that this chap is profiting from a charitable app, and so I must agree with Apple’s decision to pull it from their store. No word on if the developer, Russian Igor Barinov, will take his app to the Android Market. Many have suggested that, and the open Android Market hosts many WikiLeaks readers already.

To Barniov’s credit (and in the theme of WikiLeaks), he has made all metrics regarding his app, including how many times it was downloaded and how much money he made.

It’s not all roses for the PS3 following further developments on the thriving PS3 hacking front today, as the group responsible for the Wii’s Homebrew Channel, going by the slightly counter-intuitive moniker of fail0verflow have turned their attention to Sony‘s pride and joy and have summarily proceeded to strip it of its secrets. If you go by their word, at least.

The hack apparently enables them to gain “full control of the PS3 system,” not as a means to illegally reduced video game expenditures you see, but solely in the interests of enabling every PS3 firmware and variant to run Linux. And here we were asking ourselves why it took four years for people to hack this thing. There’s probably a lesson here, somewhere, Sony. Something about giving people what they want or the ones who can will just take it. And never ever give them what they want, then take it away again, unless you want your “Private keys” in the press. Something along those lines.

"Sandra and the former owner have been together 25 years as tenant and landlord," he told HuffPost. "The former owner was not able to get qualified for a loan, so Sandra applied. It's a great example of tenants and homeowners working together to keep control of their homes."



In addition hosting to community meetings on Tuesdays, Meacham said City Life works closely with a student organization called "No One Leaves" at Harvard and Suffolk Law schools to knock on doors in different zones in Boston every Saturday and inform foreclosure victims of their rights.



"A lot of times the brokers will go door to door and tell people they need to leave their houses," said Marielle Macher, a third-year student at Harvard Law and president of No One Leaves. "We tell people there's a legal process, and they can't be forced to leave until that process is through. Unfortunately, a lot of the tenants are not even aware that a foreclosure has occurred, and we aim to be the first people to tell them so we can get there before the bank does and explain what their rights are."



Organizations like City Life and No One Leaves are vital, Meacham said, because banks can be deceptive in "a whole host of ways, from the time people first buy their homes right through to eviction."



"The banks are refusing to negotiate with people until the eviction takes place and refusing to sell a house back to a former owner at its real value, because they look at it as a moral hazard thing," he said. "They want to punish people for defaulting on their mortgage. So we do eviction blockades or vigils where we sit in someone's doorway and risk arrest to keep them in their home, and the bank will then change its mind and start to negotiate."



Professor William Berman, who runs the Housing Clinic at Suffolk University Law School, said he is shocked by the "misguided, knee-jerk" way that banks deal with tenants in Boston.



"We have seen banks that leave tenants in foreclosed buildings without heat, or hot water, and with broken doors, windows, roaches, rats, bed bugs, and other deplorable conditions," he told HuffPost. "We have obtained settlements in the tens of thousands of dollars on behalf of tenants left in deplorable conditions by financial institutions in foreclosed buildings."



The grassroots method of foreclosure fighting is quickly catching fire: No One Leaves currently has about 100 canvassers from different law schools around Boston, and Macher said other schools in about 15 different states met recently to discuss the possibility of starting new chapters. And City Life -- which has proved highly successful in Boston -- is slowly spreading to other cities, including Chicago and Providence, Rhode Island.



"We're challenging the conditions that created the problem in the first place," Meacham said. "All the issues being raised in our street-level organizing are in sync with these international debates about finance and speculation and bubbles, so people can look at that and study it and take action at the block level to do something about it. There's a very powerful and emotional mass movement that's emerged."

Foreclosures are continuing at a reord pace, three years after the beginning of the recession. This massive turnover of property has turned entire neighborhoods into ghost towns and continued to be a drag on the economy. While there are higher incidences in “sand states” where the housing bubble inflated larger than elsewhere, this crisis is far from being localized to one region, and is prevalent all over the country. The potential damage over the next few years is even greater, as one out of every three homes in cities like Boise, Idaho are underwater.


We know that banks and loan servicers have massive incentives to foreclose, and then in many cases keep the homes off the market and in shadow inventory, avoiding the realization of a loss on their books. Banks who made crucial errors in the origination and securitization stages don’t want to be held responsible for those mistakes, and think the best way to go about that is by burying the evidence. So they have rushed to foreclose on borrowers who could have handled a loan modification, in many cases illegally so. And the stories keep getting tallied up day by day. Banks are foreclosing on the wrong homes, ones that don’t even have mortgages. Homeowners who are current on their loans are getting thrown out of their homes. Banks are faking summons, faking documents, faking notarizations, even faking lawyers, all in a desperate and chaotic effort to foreclose.


Amidst this chaos, some heroes have really stepped up. There are foreclosure mediation groups and activists, like NACA, who are setting up face-to-face meetings between lenders and borrowers. There are successful advocacy groups like ESOP in Cleveland, also mediating on behalf of homeowners. And there are the lawyers, foreclosure defense attorneys who have uncovered virtually every seedy game the servicers and the banks have been playing, who have effectively represented their clients.


If anything, the government should strongly support these efforts. The status quo is hopelessly broken, and it threatens economic recovery. The Treasury Department should demand that banks stop the rush to foreclose, and having effective representation for borrowers goes a long way toward that. But when given the option to allow TARP funds to be used for legal aid for foreclosure victims, the Treasury blocked it.

Bank Of America Lawsuits Highlight Broken, Ineffective Mortgage Modification Programs


The Attorneys General of Nevada and Arizona last week slapped Bank of America with lawsuits alleging widespread fraud occurrs in the bank’s mortgage modification programs. BofA, the nation’s biggest bank, has consistently lagged behind the other big mortgage servicers in successfully modifying mortgages for troubled borrowers. Andrew Jakabovics and I also caught the bank violating the contract it signed with Treasury to participate in the Home Affordable Modification Program (HAMP) by siphoning borrowers into its own private modification program without determining their HAMP eligibility.


But these lawsuits allege an even bigger mess, with BofA accused of giving deceptive and inaccurate reasons for rejecting modifications, and stringing borrowers along in the modification process for months, allowing them to continue making futile mortgage payments before ultimately foreclosing on them:


As a result of Bank of America’s misrepresentations, many Arizona consumers stopped making mortgage payments in a perilous attempt to qualify for help. Others waited for months for — or never received — answers on their modification requests, all while fearing that they would lose their homes; many actually lost their homes. Some consumers were misled to continue making payments in the belief that they would be able to obtain modifications and keep their homes.


Had they known they would lose their homes despite making payments, some consumers might have sough short sales or other foreclosure alternatives or simply allowed their homes to be foreclosed, saving the money from the additional payments for other necessary expenses. Other consumers lose willing buyers who could have mitigated their own (and Bank of America’s) financial losses by stepping in to purchase their homes.


Nevada’s attorney general told a very similar tale, accusing BofA of “misleading consumers with false assurances that their homes would not be foreclosed while their requests for modifications were pending, but sending foreclosure notices, scheduling auction dates, and even selling consumers’ homes while they waited for decisions.” The Upshot describes the “Boschian hell” that one Arizona family went through before having its home sold out from under it while waiting to see if it qualified for a modification.


Unfortunately, this story is all too common for homeowners seeking modifications. As Shahien Nasiripour noted today, 29,000 borrowers participating in HAMP have been stuck in the “trial modification” phase of the program for a year or more, unsure of whether they will ultimately keep their home, when that phase is only supposed to last three months. If those families are foreclosed upon in the end, they will have wasted months and months of payments that could have been used for something else.


HAMP, at this point, badly needs to fixed, and other foreclosure prevention efforts need to be undertaken. If they aren’t, the sorts of horror stories outlined above won’t stop, and the economy will continue to be weighed down by preventable foreclosures.



Scores of HOMEOWNERS DO NOT CONTEST FORECLOSURES BECAUSE:

1. They don’t have knowledge of the law in order to recognize which aspects of foreclosure are legally challengeable or even fraudulent.

2. And even those who identify wrongdoing lack funds to pay for attorneys to represent them.

3. Homeowners are told to come to foreclosure auctions with $$$$$$$ that they do not have, SO THEY STAY AWAY from foreclosure auctions.


These homeowners are oblivious about sometimes “straw buyers” and sometimes lawyers in charge of foreclosures, obtain ILLEGAL ownership of people’s homes; and pay literally nothing through “credit bids;” and that those recorded deeds from such auctions are null! For these very reasons, there needs to be a probe of lawyers who file foreclosures. http://chn.ge/eU2zAm


Also, the average lay person doesn’t know about legal REQUIREMENTS of “standing” that prevents their homes from being repossessed via non-existent lenders or via lenders which have no ownership of promissory notes.


Yet, COURTS ARE SUPPOSED TO ENFORCE STANDING and compliance with established laws! Illegal, defective, fraudulent foreclosures are the cause of useless property deeds for real estate sales; title insurance companies refuse coverage on foreclosed properties –and more!


Further, after certain foreclosure auctions (via simulation) result in fraudulent – NOT LENDER ACQUISITIONS, by lawyers or straw buyers, the common scenario becomes property flipping, neighborhood blight, rodents, and so on!


*Sample of fraudulent foreclosure acts:


–Deliberately use defunct lenders, lenders without “standing” for false civil and bankruptcy foreclosure proceedings.

– Create and conceal malpractice foreclosure delays and engineer billable litigation.

– Orchestrate sham foreclosure auctions; property never acquired by lenders, but ‘straw buyers’

– Commit actionable wrongs (unfair debt collection, fraud, various torts) that create lawsuits

– Self-dealing foreclosures which certain lawyers themselves obtain foreclosed properties for flipping.

–Foreclosures naming defunct lenders, illegally recorded property deeds, flipping, blighted communities.

– Unconscionably create false deficiency judgments against property owners after straw buyers acquire homes for pennies on the dollar.

– Intentionally false BANKRUPTCY COURT “Motion to Lift” and “Proof of Claim” on behalf of non-existent lenders which conceals fact of “NON-SECURED” mortgage debt.

–Involved in fraudulent collection of property damage insurance, as well as mortgage-default insurance.

–Fraudulent foreclosures abet loss of property taxes to city revenue, rodents, vagrants

– Thousands of families made unlawfully homeless from null foreclosure proceedings.


Foreclosure lawyers are officers of the court. Lawyers are required to know applicable laws and civil procedure; this knowledge is not required from mortgage lenders, nor loan servicers. Lawyers are the ones who file those inadequate or questionable foreclosure which lead to useless property deeds and impediments to real estate sales; title insurance companies reluctance to cover foreclosed properties; mortgage default claims disputes due to defective foreclosures.

These days, it’s hard to draw any conclusion other than that the train is gaining speed on wobbly tracks perched over a rickety bridge.

Most notably, unemployment has again risen – to 9.8% from 9.6% – very much not the direction things should be headed given the amount of money the government has pumped into the economy. The latest data shows that this nation of 310 million souls managed to add just 39,000 jobs in November. That, unfortunately, falls short of even keeping up with a population growth of about 1% – doing just that requires generating a net of about 250,000 jobs a month. As for eating away at the millions of unemployed and the many millions more who are underemployed… oh, well.

Of course, the mainstream financial media wastes no time in pointing to this latest dismalia as proof positive that the Fed’s recent decision to energetically restoke the money machine with upwards of $100 billion a month was the right decision. This despite the clear evidence that adding debt to debt is having no real effect, except begetting more debt.

This is a lesson that, so far, appears to be making no headway in the cognitions of Washington’s policy makers, even with the latest election results delivering a sharp rap across the knuckles to the power elite.

Evidence of that truth came to me during a recent drive to do sundry errands. After flipping through the stations, I ended up listening to a program on National Public Radio with a moderator quizzing a couple of congresspersons – one still in power and the other dismissed by voters in the midterm elections.

In conversing with the latter, the reporter asked if the Democrat congressman’s loss wasn’t a clear sign of voter frustration. To which the ex-official blathered on about the number of filibusters threatened by the Republicans over the last couple of years as a reason why the Obama Congress was unable to get its business done.

But, interjected the reporter, the Democrat-controlled Congress passed all manner of legislation – healthcare, financial reform, environmental bills, etc., etc – so isn’t it more a case of voters being upset about the quality and scale of the legislation passed, and not the dearth of it?

Whereupon the ex-Con began to illustrate his point by spouting off about some wastewater bill that was turned back by the Republicans, even though it would have unleashed another $15 billion in federal spending “so important to putting Americans back to work.”

But wait, again interjected the reporter, wouldn’t many people listening to this program say to themselves, this guy just doesn’t get it? That we don’t want the federal government to keep spending billions of taxpayer money on these make-work projects?

Without missing a beat, the ex-Con flipped like a freshly landed mackerel and argued against his position of just seconds before, saying, “This isn’t about the money! It’s about clean water for all Americans!”

At which point the reporter cleared his throat and ended the interview.

Next up was an angry Democrat of some influence. The congresswoman’s anger was directed first at the findings of the Deficit Reduction Commission that the spending cuts must be widespread if they are to be sufficient, and then at the administration for even thinking about extending the Bush tax cuts for people earning over $250K.

Oh, how I wish I was able to do proper justice to her diatribe here – I can’t, but I will do my best.

In her world view, the poor huddled masses of America – being defined as anyone with an income of under $250,000 a year – had nothing to do with the financial crisis, and so why should they be held even a little bit responsible for helping to foot the bill? No, no – it was the greedy fat cats that brought this fresh hell upon us, and so it is they, and they alone, who should be made to pay… and pay.

Of course, nowhere in the discussion was there mention of the role that the many-tentacled government  played in all of this… of the loose money, the looser spending, the wars, the unbridled enthusiasm for a steady diet of pork, and… and...

If there were some mega-computer capable of fairly allocating the financial pain based on the contribution each of us has made to this mess, and then assess taxes accordingly, I suspect the end result would leave past and present members of the Fed living in cardboard boxes, and 97% of past and present members of Congress shuffling in gutters looking for cigarette stubs… at least when they weren’t fighting over discarded clothes with executives of the big financial institutions, NGOs, and the Treasury Department.

Having wiped all of those individuals out to the bone, the burden could then shift to the military-industrial complex that has so effectively pursued its symbiotic and very, very costly “Don’t Ask (where the money went), Don’t Tell (the truth)” policy for decades now.

It could then lay the hooks into anyone who ever took a government-backed loan – big or small – without first taking the time to do a serious calculation as to their ability to repay it, or the unscrupulous lenders who knew that the loans they were originating were going to end up in default with the tab ultimately being dropped on the government.

In fact, were such a mega-computer able to do the calculation, I strongly suggest it would only be after many further layers that the pain, fairly allocated, would reach the rank and file business community, the sole real engine of growth in this economy.

I refer, of course, to the very same individuals so steadily derided by the vote-seeking politicos, despite the fact that it is these long-suffering entrepreneurs who wake up every new day to risk everything in their efforts to create new jobs, despite the heavy glop of bureaucracy on their backs every step of the way.

Yet it is the few that succeed, against all odds and a constant battering of taxes and regulations, that this particular congressperson sees as the villains. In other words, she has pretty much reversed the proper order of accountability – as one would expect in a system where all that matters is vote gaining.

When the talk turned to the administration’s apparent willingness to accept an across-the-board extension of the Bush tax reductions as part of a compromise to also extend unemployment benefits (at 42%, the situation of the long-term unemployed is becoming a serious problem), the congresswoman was almost apoplectic. In addition to the views just exposed, about the wealthy needing to pay for their many sins, she was astounded that anyone could hold up the unemployment extension, given the poor shape of the economy.

How can anyone argue against the direct benefits to our struggling economy of putting money in the pockets of people who most need it, she asked with dismay in her voice. Adding in support of her view that it should be obvious to all that the recipients of the money will turn right around and spend it on the necessities and that will give the economy just the boost it needs.

Hmm, I thought as I drove down the road. All we need to improve the economy is to give people money.

Why, it’s simplicity itself! And now that I get it, I think people should just quit their whining about fiscal probity and all of that, and just let ‘er rip. Don’t stop with small change, encourage the Treasury to start cranking out checks in princely sums to everyone!
Thousands, millions, even! In no time at all, America’s salad days will be back.

Of course I’m being cynical. But the point I’m trying to make is important, because while I am exaggerating, the economic concept so ardently championed by the congresswoman is accepted at face value by most of the government and all of the administration’s favorite economists.

More than that, because it is accepted, it is policy.

In this construct money is, at best, an abstraction: it has reached the point that the government, and most people, actually believe the stuff falls from the proverbial tree. Money is no longer a medium for saving or transacting with the fruits of one’s labor, but instead is a commodity – albeit unique in that it has unlimited supply.

It does not, however, enjoy unlimited demand. For now, the demand is certainly there. But as the supply increases, individuals and institutions are correctly wary of the effects of dilution… debasement… inflation, pick your term.

The alternative forms of money – the sound kind – are getting a lot of attention because more and more people actually “get it.” They are beginning to recognize the fictions that the politicians and bureaucrats believe in and are taking measures to protect themselves and to profit.

Before moving on, I would mention that I know someone who works as a manager in the Department of Motor Vehicles. A few days ago she told me that, other than a relatively brief flurry during the Cash for Clunkers program, the pace of car registrations has been slow ever since the crisis began and has shown absolutely no improvement since that program ended.

In fact, the only increase in the DMV’s workload has come from the processing of suspended driver’s licenses.

As the latest unemployment figures show and my friend’s first-hand observations confirm, this economy is not recovering. And, per the rise in license suspensions, the government is becoming increasingly aggressive in fine-generating enforcement actions.
In relationship to the second of those data points, if you’re going to imbibe this holiday season, don’t drive.

Finally, please don’t misunderstand my comments above as being insensitive to the plight of the unemployed. I personally know far too many people in that situation whose prospects of ever regaining their prior lifestyles is now almost non-existent to be cavalier about the topic.

The only realistic way I can help – because I can’t and won’t put my own family’s future at risk by trying to help everyone – is doing my part to build and maintain a business that, by offering a tangible value to clients, is able to keep a lot of people productively employed.

Therefore, it angers me to no end to listen as the morons maintained in power by the equally moronic masses make rude noises about the entrepreneurial class and otherwise meddle in matters about which they have no actual understanding and, as a consequence, continue doing great damage to the economy.

Something has got to change… and will, before this is over.



Before we get too far, let us not be led to believe that this is primarily a problem of players making too much money.  Owners are as much to blame as the players and their union.  According to Forbes magazine, the least valuable NFL franchise is the Jacksonville Jaguars, owned by Wayne Weaver.  The current estimated value of the Jaguars is $725 million.  Weaver bought the franchise in 1993 for $208 million.  Has your 401-K done this well?

My defending Super Bowl champion New Orleans Saints, owned by Thomas Benson who bought them in 1985 for $70 million, are now worth just shy of $1 billion.   This, however, is mere chicken feed compared to the most valuable franchise in the league.  Jerry Jones' Dallas Cowboys are estimated to be worth $1.8 billion.  Jones bought the Cowboys in 1989 for $150 million.

 Where did this skyrocketing net worth come from?   It came from you and me and every other NFL fan that purchases a game ticket, hot dog, pennant or any of the thousands of officially licensed NFL products.  What does the fan get in return?   For certain, there is some pride when your team does well.  My family was "in that number" braving the cold weather to greet the triumphant Saints at their Super Bowl parade last year. 

There is obviously some real monetary value to the city when fans from opposing teams come to visit.  There is even more value for those few cities who are lucky enough to host a Super Bowl. But in general, franchises take more money out of an area than they put in.  Any Saints fan older than a teenager can remember the franchise threatening to leave the city, unless a new stadium was built and if more subsidies were not paid.  At the time, the state was paying the Saints $23 million in direct subsidies.  For an eye-opening look at government subsidies to billionaire sports franchise owners, read this interesting article from Matthew Stevenson entitled The Football Franchise Hustle: Financing the NFL.
